no, take-two tried to take the rights of the duke franchise unlawfully. and they said they dissembled the 3d realms crew, but it didn't happen because they don't own duke. and lawsuits are still going on, and the game is still being developed on the side.
Actually, 3D Realms has already gotten a couple million dollars from Take-2. Duke Nukem Forever isn't going VERY quickly, but slowly, it is getting somewhere.
tl;dr, 3D Realms isn't bankrupt or gone yet.
