I'm not taking any part in this war, but I just wanted to say something. Copyrights protect your work from being stolen and don't technically need to be paid for, and trademarks are required to protect the name of said work from being stolen for other pieces of work, and those cost more than a 360. Since the name was not trademarked, Max had every right to use the name.

No, it's not. You need a link to the official trademark license and proof that you shelled out $300 for it. If it's not trademarked, people can still use the name or related names.
