it's still an abusable bill, you can still take something in free use and say it violates this law, and since most people can't afford to fight big companies they will always loose.

You don't get sued for public domain things.  Or you could argue Fair Use, whichever you're talking about.  You won't get sued over a youtube video.  No company has that kind of time.  Youtube will just remove the videos.  Use common sense.
