Is Blockland legal?

Blockland is quite similar to the Lego company and the legal issues?

Blockland is cool but I just don't want it to shutdown because of legal issues. Sorry if this was a repetitive question.

LEGO offers Badspot a job to make a game for them.
Badspot declines.
Badspot wants money, and LEGO does not allow him to use LEGO models.
Badspot changes theme, and models, to make Blockland not LEGO.
Badspot sells Blockland.

I attempt to contact the Lego guy.  I leave a phone message and email.  No reply, I figure they must be on holiday break.  In january I leave a few more phone messages and send some emails.  No reply.  Previously they had been quite prompt in replying to my messages.

i don't get why megablocks can copy the round studs but not blockland.
unless there is a separate yet not as old digital copyright being waited for.
