half the nintendo games are freeware and abandonware
super nintendo not so much.

although with roms, its legal to download them if you have the real one,
you DONT have to do the burn yourself.

Super Mario World is an awesome game. You should definitely get the ROM if you haven't played it before (though playing things on their original console is always the best).

they dont have the same laws as music and movies. pirating is extremely vague as every media has different laws, or even none at all.
cartridge games before 1981 dont even have laws and rules at all. regardless of patents.
may or may not be pirating depending on how companies respond, but lack of responding is all they tend to do so no one knows.

The backup thing is still the same, and SMW was made after 1981, so that's still the same.  Also, Nintendo still makes money off of it on Virtual Console, so it's not abandonware.
