I just realized. That was illegal what they did. They banned you for expressing your opinion. They violated the Constitution when they banned you. Freedom of Speech.

But seriously, you're technically right. However, certain restrictions (Well, many) do apply to the Constitution, and Xbox has the freedom to ban whomever so they desire, seeing as they own the franchise or whatever you'd call it. Plus, they probably don't accept insults to people, or at the very least the president.

I'm assuming that's sarcasm, because they have a Terms of Service that everyone agrees to.

I don't understand where people get the idea that a contract between the government and the people somehow governs the relationship between people and things that are not the government. The constitution loosely states that the government can't unfairly censor you. It doesn't say anything about newspapers, radio stations, television stations, websites, etc, not being allowed to censor you.

I mean if you're going to claim the first amendment guarantees you the right to say whatever you want on a website then you might as well go all out and explain how the constitution guarantees you the right to elect members to the Congress of Microsoft.
