It isn't unless his cousin is still playing. But even then I doubt it's illegal, just against the rules of buying+sharing the game.

It's not against the rules to give away the key, just looked down upon.

It is however against the rules to share the key, which the system wont let you do anyways. Though even if you play at separate times, you'll catch Baddy's attention.
