Even if you did guess it right, it's very unlikely that he would let you know that you were right.

That's both good and bad. If he's sold it, you have even better grounds for a court order. He physically cannot give it back to you, so the "Okay, I'll give it back" thing won't work.

Yeah, if he ends up selling it, take him to court and have him force you to buy a new one for the same/greater price with the same/greater specs.
