Let's say someone is in the indian caverns that some states use as tourist attractions. There's a large hole with a fence around it that keeps people from falling in. A person named Tim is walking towards the fence at a normal speed and trips. Would Tim's trip be his fault?

Well Tim ends up stumbling and bumps into the fence. It is rusted on the other side from water dripping from the ceiling but the rust is not visible to anyone walking towards it. The fence breaks and Tim falls in and dies.

If the stumble was Tim's fault and he ended up dying because of it, did he deserve to die?

Alright, so let's say you're driving. There's a speeding car coming towards you. You don't know which way it's going to turn, so you swerve left. The car also swerves left. You get killed.

Are you still a careless, stupid person that deserved to die just because you turned left when you should've turned right?
