Had the same problem awhile back. I went to a third party game shop and they cleaned the disk up in around 5 minutes.

Send it back and say the disc was scratched when I opened the case.

I did that with my BF3 disk. It was extremely scratched, i installed it, and it runs faster and its perfect.
You still need the disk in the xbox so it can verify. You have to make sure you have disk space before you do it.
EDIT: for the future, don't keep your xbox vertically

I only installed the bf3 multiplayer. You can install singleplayer if its scratched too
