Didn't get sued, got shut down because the developer sold out to some other stuffty publishers.

Which is why you can still play it under 3 different names.

Edit: But don't. Trust me it's not worth it. They spoonfeed you EXP boosts and overpowered equipment.

well, there is this one game
it's not specifically made for air combat games
but it is online
and you can even make the environment that you're fighting in whatever you want
the planes can have different models
and you can use a huge variety of weapons in the airplane
