Before that I guess stealing from villages was a grey area.
I'm not going to ban for the stealing or the killing.
Just settle it.
Also, if spit got any extra items of value that were not 'stolen' he has to return them.

If a rule isn't inplace, when it gets put in place, previous offenses are not banned.
I'm pretty sure there's a legal term for this.
