1: This is not an 8 bit game. It's pretty much 16 bit, but it's actually 64 bit (with possible 32 bit support) so neither are correct.
2: Pixel-style games absolutely do not need the NES pallete. That's like saying every realistic game needs to use the same textures as Battlefield 3.
3: The charm of the NES? That's bullstuff. Why not the charm of the amiga? Do you hate commodore 64s or something? The NES isn't the only 2D console in existance and just because a game is made in the style of 8-bit or 16-bit does not mean at all that it is NES inspired/styled.
Most of this is just cheeky horsestuff like what, do you want me to name every damn console that was released before the usage of polygons in video games started getting popular?
And here is something to 2.
Even if the NES color pallet would make a comeback in a retro game, the charm will never really be restored. The part of the magic in the older games was the ways how developers of the old times tried to overcome the limits from everything to lack of buttons to lack of graphical or performance. Those people really knew how to think outside the box. Today's developers don't have any real limitations as far as retro games do. There is nothing encouraging or forcing them to try to make something cool and/or neat, innovative, because their limitations are so non-existent.
