Are you saying the situation is different enough for people involved that have bad reputations to not be treated like they have them? I don't think that's what you're saying, because that doesn't make sense.

Second wasn't a threat to call authorities, a lawsuit is between two citizens bud, not police.

If a person is known to spit water at people on the playground, does it not make sense to assume that if you see them walking inside with a teacher with their head down, that they got in trouble for doing it again?

I really can't think of a better way to put that without repeating myself.
