it sounds like he was still refusing to put it down and just wanted to debate how fake it was to them.

Not entirely true.

If someone is brandishing a weapon/fake weapon in a threatening manner you have to order them to put the weapon on the ground. If they fail to comply you can shoot them, even if they start pointing it at you. What happens if you don't use force after ordering them multiple times to drop the gun.

Yep. He should've dropped the gun, but they shouldn't have just blown him away like that, no matter what skin color his is.
