If you aren't allowed to assemble, you can be arrested.

Remember, you may have the right to assembly, but you need a permit to assemble.

I have feeling that all the original protesters went home. The remaining rioters are just people who want free stuff who are also willing to steal from their neighbors.

Basically you are good to good as long as you aren't hurting people, obstructing business or traffic, and you aren't making a mess. The ACLU could better explain it.

Rioting is not allowed, that is a violent action against the city government and its people. That is not activism, that is pure and misguided barbarism.
