I think the only hacks that should be allowed are aesthetic ones that can only the hacker can see. 
Like 'Red' and 'White' Ink.

If anything is released, people will figure out to take it further. Ideally it would also make it that much easier for Nintendo to do something about, but right now it seems like the exploit itself would be very difficult for them address.
