Are Syrian citizens living in Syria under US jurisdiction?

I mean, they would if they're trying to come here...

The ban is unconstitutional because it violates the establishment cause. Making laws that discriminate based on religion is still illegal, even if the victims are non-citizens.
The ban doesn't discriminate based on religion though, it just bars immigration from 7 countries which were already chosen by the Obama administration.

It specifically allows homeland security to "prioritize" refugees of the minority religions in these countries, which are Christianity and Judaism. Yes, it discriminates based on religion. No way around that.

I don't know why it's so hard for you to understand what I'm saying. I've been trying to say this whole time that if someone isn't in the US then they aren't under US jurisdiction. Doesn't matter whether or not they're trying to come here, all that matters is if they're here or not.
