Plenty of cultures have had 3rd genders and such but that's not the point. What he's saying is that there shouldn't be different bathrooms for different genders; just have one bathroom for everyone regardless of gender.

A jury isn't going to side with a man who has molested a woman in the bathroom just cause he threw his hands up and went "But I'm transgender!", they're going to say "But you molested a woman!" and imprison the stuff out of him.
Men who do this stuff usually go after little boys anyway, in like McDonalds when there's almost no one in there. If they want to make a law to protect people in the bathroom, they should make it so love offenders and child enthusiasts aren't allowed in public restrooms. Nothing is stopping a man from going into the women's room to be creepy now anyway, and no law will ever give a person the right to peep at people in toilets and rape them, criminals will always be criminals.
With how much loveaul assault is thrown around these days no one will believe you were raped in the bathroom unless someone else was in there too. While yes a rapist already doesn't care about the law by allowing people to use the bathroom they see fit you can't just go "that guy is up to something" when he goes in the womens' bathroom.

Why not? The law doesn't police your brain, you can think whatever you want, and if you think someone looks suspicious then by all means investigate.

If I dressed up as a woman and went into the woman's bathroom there is a good chance I could get charged as a love offender if they find out I'm a male.

Yes you can? Even if you went into the mens restroom and saw a man that was suspicious you could still report them as suspicious.

People who have taken advantage of this policy at Target so far:

Trans people doing their business, washing their hands, and leaving.
Cis dudes wearing wigs and walking into the women's room to "prove a point".

Obviously it's the trans people who are being intrusive and bothersome.
