Ik it's the defense, but fair use is an arm of free speech, more or less.

Either way, it won't get anywhere because it is, or at least appears to be, a case that can't be one by the plaintiff.

wouldn't say that with too much certainty, wether it's within fair use/being a bullstuff lawsuit doesn't really matter if the Jury thinks otherwise, as they stated the Jury most likely won't even know what's going on with this whole YouTube debacle.
