In rape, DNA is very easily either contaminted, damaged, or lost due to consensual love, urination, bathing, procrastination, or otherwise. Because 99.99% of everyone's DNA is identical, it's virtually impossible to determine identity from incomplete scraps.

yeah dna would only help if you already have a suspect, and even then it's probably more expensive than the state would probably care for unless it were a more serious case. at any rate, the vast majority of crimes don't even go to trial, they're settled with plea bargains, so evidence isn't always so much an issue, you just need enough to prove you have something to charge them with if they ask

Women can choose not to get the DNA test because of "embarrassment" and the court will still side with the woman despite no evidence and refusal to give evidence.

A woman can also claim rape with absolutely no proof 10 years later.

A woman can claim rape if she later regrets the love act despite it being 100% consensual.

i can claim rape because i don't like someone, that doesn't mean they'll be charged with anything. any reasonable court of law will dismiss cases that have insufficient evidence. the real problem is if you have a jury trial that wrongly reaches a guilty verdict
