The concepts of the weapons and stuff seem to be similar but you can't say that any game with any similarity to another game is a rip off of said game.

So what, there are many possible positions characters can be in, it's probable that people got similar looking photos, the person that made those probably worked hard to make sure the poses looked similar so they can fuel the controversy of this situation.
