When used for private use, I believe that it would be legal even without permission, if it's released, then the poster would be breaking the copyright not badspot.  Badspot is not responsible for user created content, but is responsible for deleting illegal content from the forum.

The lego type player was in V1 and V2. But was removed in retail, due to the fact that lego was going to sue Badspot's ass all the way to Tuscany.
