Also, Haven and Hearth starts to work again, and I spawn at hearth fire. I walk around, repairing my place and notice a little settlement 2 tiles north-west from my claim boundary and it doesn't have a claim. This means I can't increase my claim because they might need the space. Should I claim over it or talk with the owners of it?

It depends, make an assumption of their combat ability and if they're weaker do whatever the hell you want.
