Exactly and it is LEGAL to jailbreak an iPod/iPhone or any phone thanks to the new DMCA exemption which specifically allow jailbreaking. What makes the matter ILLEGAL is when people are able to download Apps for free.

I am allowed to say I jailbroke my iPod but how I did it is ban-able but if it's legal to jailbreak... How is that being a pirate?

OT: I enjoyed "Cut the rope". Too easy but really fun.

Jailbreaking is not illegal. It is against Apples terms of service so it will void your warranty if you jailbreak your device. However, pirating is illegal, and that isn't Apples decision just because someone pirates on there device.
