A demo is a limited portion of the game, whether it be content-wise or time-limited.
Playing the full version of a retail game without paying = piracy.

Please understand that there isn't exactly many facts that you can gain on this subject. What I'm saying is that yes, it's piracy. I never denied that. But I'm trying to help you understand my point of view, which is that they're probably just testing the game before they buy it. I do the same exact thing. I play it for 5min, then decide if I wanna play it or not.
Not all games have demos. But with games being so expensive nowadays, most people want to be sure that they want the game.
To be fair, as long as they buy it afterwards, it shouldn't be piracy. They would have a copy of the game, and no longer have a need to use the emulated version.
You are. All unauthorized distribution is copyright infringement, so unless Nintendo is running the site themselves (which they're not), it's not legal. It might also be DRM circumvention, which might break the Digital Millennium Copyright Act (with the exemptions in the act itself which I am not familiar with, and the exemptions the Library of Congress made within the last year or so).
