Both bills talk about how you have to be hostile to the united states for this to apply.
(8) engaging in, or purposefully and materially supporting, hostilities against the United States.'; and
(2) by adding at the end the following:
`(c) For purposes of this section, the term `hostilities' means any conflict subject to the laws of war.'.
I will however add that this is an amendment to a law, which I cannot find "Immigration and Nationality Act (8 U.S.C. 1481)" as it's referenced in over 326 other bills. though based on the context I assume it allows american citizens to be arrested when "engaging in, or purposefully and materially supporting, hostilities against the United States."
