they can, as can iTunes even though iTunes store-bought songs are .m4as. the OP thinks they need to be m4as though and that's not right.
but yes, illegal, against forum rules, i'd suggest lock.

My second gen never played downloaded tracks. :/

both my nano and my touch both played mp3s (second gen and i think third? gen)
and yeah not pirated, they weren't available on the iTunes store and were from soundcloud

Some artists have a free song on their website.

To put .mp3s on your iPod, you just locate your .mp3s on your computer by clicking >Files>Add file to library... , then you click the add/open button or whatever then sync up your iPod to your computer.
And that's how to put downloaded audio files on your iPod.

As for finding free music, in most cases that's illegal.
