They use to be able to until 2010 when Obama's new head of the FCC decided to promote net neutrality without a solid justification (legally and practically). It's largely political cause Obama made a campaign promise about it I think.

Also anyone who thinks this will lead to a totalitarian control over the internet is conjuring up the slipperiest slope I've ever seen.

In my area I have Cox and Verizon FiOS, among with a couple others. This might not be true everywhere, but I'm very certain that the FCC will enforce some anti-trust in these areas in the near future.

The FCC still holds regulatory authority rules over net neutrality still, they just have to handle cases on a case by case basis now

hardly conspiracies, just more what-ifs. History has its ugly way of repeating itself. Without people who observe these things and just have people who took things for granted, then there is a chance that eventually we see a new incarnation of the old monoplies that controlled everything. If that day never comes, then we have nothing to worry. However for the time being the future is uncertain.
