Definitely isn't breaking any rules, but I think he forgot that he put Earth into a very long nuclear winter.

It is like dancing off and on the base in baseball, which would be "legal" but would waste time. An umpire would tell you to stop it because it wouldn't be baseball.
This isn't roleplaying, this is nation/player killing in the age of nuclear warfare.
