Author Topic: Re: [Swholli's Movie Reviews] - The Worst Christmas Movie Ever  (Read 8982 times)

I want to do something special for this milestone, but I'm not sure what.
Guardians of the galaxy!
Or godzilla!
No wait, battle los angeles!
Or the avengers!

So, hey wow guys Jurassic World did some of the things I predicted in my video, but they only did two, and they were only for a few minutes and were actually handled well.

The rest of the film was exciting and enjoyable. Not better than Jurassic Park in the slightest, but definitely took the spot at nimber 2 in top 4 JP movies.

I'm going to do a written review (which will include spoilers be warned) later, right now I'm gonna play the new LEGO Jurassic World and see of its as good as LEGO Star Wars was.

that is absolutely dumb. that should be covered under fair use. it's critique/review
fair use doesn't cover anything that you're making money off of
because... it wouldn't be fair

You can make money off of criticizing other people's work, and you're allowed to use the work so long as you're using it as example and/or citation of your sources.

You can't upload a whole film and not add or commentate on it, that's not fair use. You can take it and talk about it.

Now, it is a little different if you upload the whole movie start to finish while commentating over top of it, because then you're profiting off of someone else's work because all you did was talk over a movie (this is of course different than a game because you interact with and change games in real time).

yeah, I was wrong about what I said
but still using it as an example isn't really the same as the entire video being about it

Notwithstanding the provisions of sections 17 U.S.C. § 106 and 17 U.S.C. § 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include:
  • the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
  • the nature of the copyrighted work;
  • the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
  • the effect of the use upon the potential market for or value of the copyrighted work.

I haven't watched it, but it's probably safe to assume that the majority of the twilight video consists of scenes or screenshots from the movie
the jurassic world one is pretty ridiculous though

I'll admit I used clips as a background to me talking, but most of the time they were attempted to be contextual to what I was saying.

Really the only time the content recognizer decides to flag my reviews is when I use a clip in it's entirety, which includes the audio from the clip, but obviously I'm prefacing those clips with context as to why I am showing them, thus:

Quote
  • the nature of the copyrighted work;

Context is everything, and fair use is applicable given the context.

My original beef with Youtube's copyright detecting robots is that they don't understand context and thus will flag anything without even reviewing why or how much of it is there.

I'm saying they need to stop using robots and go back to a user flagged system, or some sort of moderation to the robots themselves to determine if they've found a feature film uploaded illegally or just a kid's birthday party that happened to be playing Katy Perry on the radio in the background.

Sorry I'm late on this one, Star Wars Special has begun!
