Yes, the legal system is biased against horrible ideas that fall outside the purview of the Constitution.

this is exactly my point. people go on about how the ban is unconstitutional yet say we shouldn't follow the constitution because it's archaic. you can't have it both ways.

This effectively means explicitly deprioritizing Muslim refugees in those countries, which is in violation of the 1st Amendment's right to freedom of religion, along with the Equal Protection Clause of the 14th Amendment, singling out individuals for their religion and nationality.

Are Syrian citizens living in Syria under US jurisdiction? If they are in the US, legally or not, they get protection, however if they are outside of the US, they get none of our rights.

The ban is unconstitutional because it violates the establishment cause. Making laws that discriminate based on religion is still illegal, even if the victims are non-citizens.
