It'd be really hard to convict someone of anything when all the signs are there to say it's fine with the owner.
it's not "convicting," this isn't a criminal offense. but the owner has not said in any way that it's fine to breach their terms of service
you admittedly may win the suit if you get a jury full of other people who also feel entitled to use other people's work for free without their permission, but I wouldn't count on that

if these things are illegal, they're illegal, and that's the end of it. this isn't about whether or not they will enforce it
and in the case of those laws it's also very unlikely that a jury would find you guilty, because those laws are ridiculous

No, it clearly says he promises to if yes. This is not a simple matter of inversion. In simpler terms...

IF it works on your computer, you DO PROMISE to purchase a liscense.

Promise does imply an obligation, in fact. An obligation only met if it runs, sure, but I doubt many people have issues running WinRar.
