I use roms but i actually have the games so it's legal i think.

In America all Roms not made by the company that holds the original copyright are illegal. The only way to legally make a ROM in America is to have no copyright on it.

Not true, if you have the game it is supposed to be legal to emulate it.

Whether or not these warnings in this specific form can be considered valid contracts is legally questionable.
