When? It's perfectly legal if they aren't selling anything, isn't it?
Only if they don't use any copyright material. EX: Ripping sprites from games, map graphics, etc. even if you give credit and don't sell it.

My bad, they don't sue you. They send you a cease or desist letter for making it.

You can try emailing Nintendo about the consequences of making a fangame.

I've also went into their official forums(before it was Support), they would remove fangames made by users.

Bungie doesn't care if you make an adaption(fangame) of their game, Nintendo does.

All fan games are illegal, the reason people think nonprofit fan games are not illegal is because a company really isn't going to take the time to sue you because they have nothing to gain from it. If you are making profit off of it then you can kiss your ass goodbye because any company would sue for that.

I'm not saying I would make it, I was thinking if Nintendo can.
