It's not that there's likely 1 germ that gets left behind. Hand sanitizer is formed of chemicals which are near enough guaranteed to ensure that everysingle germ it comes in contact with will die.
THey only say 99.99% in case there happens to be one case where some bacteria is left, or is immune and that prevents them from being sued.

If you use Hand Sanitizer correctly there is essentially no chance of any bacteria being left.
If you use a Condom correctly, there is still a chance of it not working. And that's due to what has happened with the condom, not the design of it. If it's been ripped or teared in packaging or handling or whatnot, then that could be the fault. The design of condoms is perfect when it leaves the factory.
