fallout 1 and 2 aren't available for sale anymore. is it fine to pirate those games because of that?

GoG offered them for free a few weeks ago

You could always just get it off eBay or some stuff.

they're currently floating in muddy legal waters due to the bethesda/interplay rights fiasco. they're not actual abandonware, though, so it's still pirating.

there actually is no such thing as abandonware.

its just the fake term people use to refer to software that no one will care is shared.
technically someone still owns the rights. and technically no permission was ever given to openly allow it to be shared.
but its accepted as safe to download because its never expected to be enforced. these are nearly 100%, games that CANNOT earn money, even if they tried.

no, because they arent abandoned. they just arent retailed anymore. thats not the same thing.
