We were really just discussing whether or not it was illegal and if it is something that could prompt such action being taken, not the likeliness of someone actually bringing the matter to court.

The itunes scenario isn't fine because the winrar terms have not suddenly changed without warning, they have warned that the software isn't free right from the start.

I still think it's highly, highly, highly unlikely that rarlabs would ever sue an individual for not paying. It would literally cost them more than they could possibly be rewarded as damages from you.
