Because he's not talking about love. In many circles, being 'male' means expressing masculine qualities. It's confusing, but they're equally legitimate definitions.

Practically speaking, it makes sense to refer to people by their gender expression instead of their love, since you're much more likely to see their gender expression before their genitalia.

because there's a difference and "male" can mean either of them, and the answer is different depending on which you choose.
