The police can't look at the video and file out a search warrant on this guy because he already got charged for the crime committed in the video and cannot be charged twice.

i suppose you won't mind if someone goes to dig up your grave (or right next to it) dressed as a pirate while they film it and then put in on youtube (or whatever video service they will have then) and say it's just a prank, then. some will support them doing it, most won't. some will defend them, some won't.
