I wouldnt. The idea sounds ridiculous.

Well someone's soul is their property, so I'd assume its stolen

Technically, yes, it is their soul but no, its not a stolen item.
The soulstone itself if yours, and if you were to go to jail it would be treated as such.
Even if it was, it wouldnt make any sense whatsoever. The guards cant tell stuff,

Black Soul Gems should be illegal anyway, just because there is no way to prove you filled it with the soul of a bandit, or a good citizen of skyrim.

realistically though, if a guard was to find a soul gem on you and not know anything about it, they would consult the castle mage for guidance.

Realistically, if you stole someones soul, every measure would be taken to restore the soul to a body and you would probably get executed

when I say realistically I mean realistically in skyrim lore.
people don't get executed for murder in skyrim.

At the beginning of the game, however, theres like forgetin 8 carts filled with dudes to be executed

Its not possible for all of them to murder the high king with a thu'um, its highly unlikely that absolutely all of them stole horses because there really isnt all that many horses in Skyrim, and you just go to prison for thievery

So perhaps you can indeed be executed for murder if you're not a Dragonborn, though that's only speculation.

they are all convicted for treason because they are rebels
