It certainly opens up the door to this, which is what nintendo is worried about.
But homebrew is not piracy.
Technically what is described in these posts aren't homebrew but a way to enable a homebrew community.

This is an exploit to allow the nintendo switch to become a more open platform, albeit an unsupported open platform.

You only end up bricking your console if you don't follow the damn directions or follow dipstuff youtube tutorials.
