If they have repeat offenses on their criminal record, then yes, they are probably a repeat offender. But you have a point. My point is when deciding between applicants you should be looking at all the information you have on them to make your decision.
Now I see why you're mad. I wasn't talking in the context of affirmative action at all! That would be a horrible reason. Positive discrimination is unfair because giving a certain race privileges is just unfair, black people are in no way inferior but also don't deserve benefits (and neither do white people, to make that clear.)I wouldn't want special privileges over black people...
Except they do deserve benefits. Diversity benefits schools and workplaces. Minorities are still extremely discriminated against. By allowing more qualified minorities into the workforce/high education we help improve their economic situation and the state of their community as a whole, in order to work towards a more diverse and equal America.

Yes it is tribal. Whites aren't as discriminated against as minorities. It would be putting favor on those who don't need it. Race is not black and white, racism is not over, switching the races in situations and comparing the results is an ineffective argument because of how race works in today's society.
